We represented the plaintiff, an English company acting as a commissioned
representative for a U.S. company selling products in Iran prior to the
adoption of the Federal Iran Transaction, sued for unpaid sales commissions
.... The trial court dismissed the complaint based on the Treasury Regulations,
and plaintiff appealed. The Secretary of the Treasury intervined aa amicus
curiae and the Fourth Circuit reversed, holding that the regulations applied
only to prospective sales.

787 (D.D.C. 1985).
Phil represented the plaintiff in a wrongful death action brought in Washington,
D.C., against an Ecuadorian airline arising out of a crash in the jungle
of Ecuador Jurisdiction was alleged based on the airline's having obtained
financing guarantees through the ExImBank. The defendant airline successfully
argued that it was a foreign state within the meaning of the Foreign Sovereign
Immunities Act, and the suit was dismissed.
Trojan Yacht Co. v. Productos Pesqueros Mexicanos, S.A. de C.V.,
1978 A.M.C. 1539 (E.D.Va. 1978) aff'd 1978 A.M.C. 2680 (4th Cir. 1978).
Phil represented a Mexican buyer of commercial fishing craft under a sales
contract incorporating a Mexico City forum selection clause in a suit
brought by seller for purchase money withheld by buyer in a dispute over.
The court sustained defendant's motion to dismiss for lack of jurisdiction,
and the Fourth Circuit affirmed.
